Procedural rules
All appeals will be processed under procedural rules that set out how cases will be handled.
Appeals received from 3rd November 2008 will be handled under ‘The First-tier Tribunal (Health, Education and Social Care Chamber) Rules 2008’.
Appeals received before 3rd November that are still ‘live’ on that date will also be handled under the First-tier Tribunal rules from 3rd November.
However, the Principal Judge for care standards appeals may apply any provision of the rules that applied before or after 3rd November if they believe that this will ensure a fair handling of your case.
The rules that applied to appeals received before 3rd nov are the Protection of Children, Vulnerable Adults and Care Standards Tribunal Regulations SI 2002 816 as amended.
The above procedural rules set out the responsibilities of the parties to appeal in providing information and evidence as well as the responsibilities of the President, Tribunal panel and the Secretary in handling appeals.
